Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the Essaypass website, mobile website, and related services (collectively, the "Services"). By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Cookies Policy, Refund Policy, and any service-specific terms referenced herein. If you do not agree, do not use the Services. You represent that you are at least the age of majority in your jurisdiction or have valid parental/guardian consent.

Definitions

  • "Website" means the official Essaypass site(s) and mobile interface(s).
  • "User," "you," "your" means any individual who accesses or uses the Services, with or without registration.
  • "Order" means a request you submit for paid deliverables or paid features, including scope, requirements, and deadline.
  • "Product" means content or materials delivered to you pursuant to an Order.
  • "Tools" means on-site automated features (e.g., AI writing, rewriting, detection, plagiarism checking).
  • "Personal Balance/Credits" means funds or credits visible in your account.
  • "QA" means Essaypass internal quality assurance review.

Service Description

Essaypass provides AI-assisted long-form writing tools, academic-style formatting helpers, and lawful academic assistance services that support learning, research, editing, organization, and compliance workflows. The Services are not a marketplace and do not connect you with external "experts." You are solely responsible for how you use any output. Essaypass does not guarantee grades, admissions, or any academic or professional outcomes.

Lawful Use and Academic Integrity

You agree to use the Services only for lawful purposes and in accordance with institutional policies. Do not use the Services to cheat, impersonate, submit others' work as your own, or violate academic honesty rules. You remain responsible for reviewing, verifying, and editing any output before use or submission.

Account Registration and Security

Some features require an account. You agree to provide accurate, current information and to keep your credentials secure. You are responsible for all activities under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms.

Ordering, Delivery, and Revisions

  • Placing Orders. When submitting an Order, you must provide complete and final instructions, references, and any required materials in a timely manner. We may contact you to clarify details.
  • Delivery. Digital Products are delivered via your account dashboard and/or email notifications. You are responsible for timely download and storage.
  • Revisions. If a revision policy applies to your purchase, it will be stated at checkout or in your Order confirmation. QA may decline revision requests that materially change the original instructions. Additional work outside original scope may require additional fees or a new Order.

Pricing, Payments, Taxes, and Credits

  • Pricing and Fees. Prices and any service fees are disclosed at checkout and may be updated from time to time for future Orders.
  • Payments. Payments are processed by third-party payment processors. You authorize us and our processors to charge your selected payment method for the Order total, applicable taxes, and fees.
  • Currency and Bank Fees. Charges are processed in the shown currency; your bank may apply conversion or foreign transaction fees.
  • Credits and Promotions. Only funds you personally paid are refundable to the original payment method (see Refund Policy). Promotional credits, coupons, or bonuses have no cash value, are non-transferable, and can be used only within the Website as specified.

Refund Policy (Summary)

Refunds are handled under our posted Refund Policy. For clarity, Essaypass applies a binary outcome: either a full (100%) refund or no refund, subject to the Refund Policy terms (e.g., material non-delivery/non-conformity verified by QA, verified double billing, accidental duplicate Order handled before meaningful production, verified originality breach with reputable evidence, etc.). Please review the Refund Policy for procedures and evidentiary requirements.

Ownership and Licenses

Your Inputs and User Content. You retain ownership of materials you supply. You grant Essaypass a non-exclusive, worldwide license to use, process, and store your User Content solely to operate, maintain, secure, and improve the Services, comply with law, and resolve disputes.

Product and AI Outputs. Subject to your compliance with these Terms and applicable law, you own the Product and any AI outputs you generate. You are free to submit, publish, distribute, or otherwise use such content.

Internal Copies. Essaypass may retain limited copies and internal fingerprints of content as required by law and for compliance, security, fraud prevention, and dispute resolution, consistent with the Privacy Policy.

Essaypass IP. We and our licensors retain all rights in the Services, software, models, site design, and brand elements. We grant you a limited, revocable, non-transferable license to access and use the Services for personal, lawful purposes.

Tool-Specific Disclaimers and Limitations

AI writing/rewriting, detection, and plagiarism tools are automated, may be inaccurate or incomplete, and can produce false positives or false negatives. Results are advisory and not a substitute for your judgment, fact-checking, or professional review. Outputs may contain errors, biases, or outdated information. You are solely responsible for verifying accuracy, originality, and appropriateness before use.

Acceptable Use

Do not upload or transmit illegal, infringing, harmful, harassing, obscene, defamatory, or otherwise objectionable content; malware; or attempts to bypass security. Do not reverse engineer, scrape, or overload the Services. We may suspend or terminate access for violations.

Third-Party Services and Processors

Payments and certain features may rely on third-party providers. Their terms and privacy policies apply in addition to ours. We do not control and are not responsible for third-party services.

Privacy

Our collection and use of personal data are described in our Privacy Policy. Some service communications are mandatory (e.g., transactional notices). See the Privacy Policy for details and rights.

Warranties and Disclaimers

THE SERVICES AND TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESSAYPASS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ERROR-FREE, ACCURATE, ORIGINAL, OR MEET ANY SPECIFIC OUTCOME, INCLUDING GRADES OR ADMISSIONS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESSAYPASS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR AGGREGATE DIRECT LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, THE MINIMUM MANDATORY LIMITS APPLY.

Indemnification

You agree to defend, indemnify, and hold harmless Essaypass and its affiliates, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Services, your content, or your violation of these Terms or applicable law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of [Governing Law: __________], without regard to conflict-of-laws rules. The parties will first attempt to resolve disputes informally within 60 days. Failing that, the dispute will be brought exclusively in the courts located in [Venue: __________]. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL TO THE EXTENT PERMITTED BY LAW.

Export and Sanctions Compliance

You represent that you are not located in, under the control of, or a national/resident of any country or list subject to comprehensive sanctions. You will comply with all applicable export, re-export, and sanctions laws.

Changes to the Services and Terms

We may modify or discontinue any feature at any time. We may update these Terms from time to time. Material changes will be posted on the Website and, where appropriate, notified by email. The version in effect when you place an Order or use the Services applies, subject to applicable law.

Severability; Entire Agreement; Contact

If any provision is held invalid, the remaining Terms remain in effect. These Terms, together with the referenced policies, constitute the entire agreement between you and Essaypass regarding the Services.
